3. How to Book a Photo Session

Currently, you can book a photo session via:

  • Instagram;
  • Telegram;
  • WhatsApp.

There may be buttons on the website that lead to these communication channels.
Submitting an enquiry does not constitute an automatic booking. A date is considered booked upon my written confirmation and receipt of the deposit in accordance with these terms.
Prior to confirming the booking, the client must be given the opportunity to familiarise themselves with the session conditions, pricing, any additional expenses, and the cancellation and rescheduling policy.
By confirming the booking after receiving these terms, the client confirms that they have read and agree to them. This does not affect any mandatory statutory rights the client may have under the law.

4. Booking and Payment

  • To reserve a photo session date, a deposit of £25 must be paid.
  • The remaining balance of the photo session cost is payable before the start of the shoot or on the day of the shoot, in accordance with a written agreement.

A date is considered booked after:

  • we have agreed on the date and main details of the photo session;
  • I have confirmed the booking in writing;
  • I have received the deposit.

The deposit is credited towards the total cost of the photo session.
Any additional expenses, including studio hire and travel costs, must be communicated to the client before the relevant expenses are confirmed.
The rules regarding deposits and cancellations are applied with due regard to the client's statutory rights.

5. Cancellation of a Photo Session

If the client cancels the photo session less than 3 days before the agreed date, the deposit is generally non-refundable, to the extent permitted by law.
If the client cancels the photo session at least 3 days in advance, the possibility of refunding or transferring the deposit is considered in accordance with the agreed terms and applicable legislation.
These rules do not mean that the deposit can be retained under all circumstances. The client's statutory rights regarding cancellation or refunds take precedence where applicable.

Cancellation on My Part

If I am unable to conduct the agreed photo session, I will notify the client as soon as possible.
Depending on the situation, I will offer to reschedule to a new date or refund the payment for the service that was not provided, in accordance with the law and the circumstances of the booking.

6. Rescheduling a Photo Session

If the client wishes to reschedule the photo session, they must notify me as early as possible via Instagram, Telegram, WhatsApp, or email.
The possibility of transferring the deposit to a new date is considered individually, taking into account circumstances and date availability.
Following the agreement to reschedule, I will confirm the new date and corresponding conditions in writing.
Rescheduling is not guaranteed automatically, but each request is considered separately. This section does not limit the client's statutory rights.

7. Express Photo Editing

For an additional fee of £40, express photo editing can be ordered with delivery of the completed gallery within 5 days, provided this possibility has been agreed prior to booking.
Express editing is not included in the standard package price.
I provide finished, edited photographs. RAW files and other unedited originals are not provided.

8. Delivery of Final Photographs

The final photographs are delivered to the client in digital format via Google Drive in high resolution.
The link to the folder containing the photographs is sent to the client once editing is complete, within the delivery timeframe specified in the selected photography package.
The client can view and download the photographs to their own device using the provided link.

9. Additional Travel and Studio Expenses

Studio hire is not included in the price of packages where it is explicitly stated that it is paid separately.
An additional travel fee may apply for remote locations. The amount depends on the location of the photo session.
I will inform the client of such expenses before booking or before the client agrees to the relevant additional services.
Additional expenses must be agreed upon in advance.

10. Lateness, Weather, and Unforeseen Circumstances

The client must arrive at the agreed time.
If the client is late, the actual duration of the photo session may be shortened unless it is possible to extend the shoot without altering other arrangements.
If weather conditions, safety hazards, location issues, or other unforeseen circumstances make the shoot impossible, I will contact the client to agree on a practical solution.
This may include rescheduling the photo session or another option agreed upon by both parties. Any decisions regarding refunds are made taking into account the booking conditions and applicable legislation.

11. Copyright in Photographs

All photographs created by me and published on the website belong to my creative works and are protected by copyright in accordance with applicable legislation.
Without my prior written permission, it is prohibited to:

  • copy photographs for reuse;
  • publish them on other websites or pages unless such use is permitted by these terms;
  • sell photographs or use them for commercial purposes;
  • use photographs in advertising or for business promotion;
  • pass off my work as the work of another photographer;
  • edit photographs or create derivative works where permission is required and has not been granted.

If you wish to use a photograph from my website in a manner not permitted by these terms, please contact me first for written permission.
The mere fact of viewing, downloading, or receiving a photograph does not constitute a transfer of copyright.

12. How the Client May Use the Received Photographs

Upon receiving the finished photographs, the client is authorised to use them for personal and non-commercial purposes, including:

  • storing them for personal use;
  • printing them for personal use;
  • publishing them on their own personal social media accounts;
  • sharing them with friends and family.

This authorisation does not transfer copyright in the photographs to the client.
Without my prior written permission, the client may not sell the photographs, use them in advertising, for business promotion, or transfer them for commercial use.
If the client wishes to use the photographs in any other way, they may contact me to agree to this in writing.

13. Publication of Client Photographs in My Portfolio

I do not publish photographs in which a client can be recognised in my portfolio, on the website, on social media, or in promotional materials without their prior separate written consent.
Consent may be given via Instagram, Telegram, WhatsApp, or email.
The consent must clearly state that the client permits the publication of the photographs. It is also desirable to specify where exactly they may be published and for what purposes.
Booking a photo session, paying a deposit, or receiving photographs does not in itself constitute consent to their publication.
Refusal to consent to publication does not affect the ability to book a photo session.
The client may withdraw their consent for future use of the photographs. Upon receiving such a request, I will cease further use of the photographs to the extent required by law and take reasonable steps to remove them from resources under my control.
I cannot guarantee the removal of copies that have already been shared by other persons or saved on third-party platforms outside my control.

Photographs of Children and Other Individuals

If the photographs contain children or other individuals, the consent of the relevant persons, parents, or legal guardians may be required.
The person booking the photo session must have the necessary authority to organise the photography of children.
Consent to be photographed does not imply automatic permission to publish photographs of a child.

14. Use of the Website and Prohibited Actions

The website may be used for the lawful viewing of my work, information about services, and contact details.
When using the website, it is prohibited to:

  • use the website for illegal activities;
  • attempt to gain unauthorised access to the website, server, systems, or data;
  • intentionally overload the website or interfere with its operation;
  • upload or distribute viruses, malicious code, or other dangerous materials;
  • bypass technical protection measures;
  • collect personal data of visitors without a lawful basis;
  • copy content by automated means in violation of the law or without the necessary permission;
  • pass off my work as your own.

If I have reasonable grounds to believe that the website is being used for attacks, fraud, or other unlawful activity, I may take reasonable measures to protect it.
Such measures may include temporarily restricting suspicious activity, contacting the hosting provider, and, where necessary, notifying competent authorities.
I may retain relevant technical records and evidence to the extent permitted by law.
This section does not prohibit the lawful use of the website, ordinary browsing of pages, or other actions permitted by law.

15. Technical Issues and External Services

I strive to keep the website operational, but I cannot guarantee its uninterrupted availability or the absence of technical errors.
The website may temporarily be unavailable due to maintenance, technical glitches, hosting issues, or other circumstances.
The website may contain links to Instagram, Telegram, WhatsApp, and other external services. They have their own terms and privacy policies, and I do not control their operation or content.

16. Liability

I aim to provide photographic services professionally, with due attention to detail and in accordance with the agreed terms.
Photographs may vary slightly in colour or brightness depending on the device, screen, and its settings.
I shall not be liable for disruptions in the operation of third-party services or circumstances beyond my reasonable control, to the extent that such limitation is permitted by law.
However, these terms do not exclude or limit liability in cases where it is prohibited by law. In particular, they do not limit liability for death or personal injury caused by negligence, and they do not override mandatory consumer rights.
If an issue arises with the photo session or the photographs received, please get in touch with me so that we can discuss the situation and possible solutions.

17. Complaints and Dispute Resolution

If a client has a complaint or is dissatisfied with a service, they may contact me:

  • via Instagram, Telegram, or WhatsApp;
  • by email at the contact address specified on the website.

Please describe the problem and, if possible, indicate the date of the photo session and the name of the chosen package.
I will review the enquiry and endeavour to find a fair solution.
This does not deprive the client of the right to apply to relevant authorities or utilise other dispute resolution methods provided by law.

18. Personal Data and Cookies

When using the website, certain information may be processed in accordance with consent settings and current legal requirements.

If you have consented to analytics, the website may collect the following information:

  • which pages you open;
  • which links and buttons you click.

You can read more about this in the following documents:

  • Privacy Policy: Here.
  • Cookie Policy: Here.

Please familiarise yourself with these documents to find out what data may be collected, what it is used for, and how to manage your consent settings.

19. Changes to These Terms

I may update these terms if services, prices, website features, or legal requirements change.
The updated version will be published on this page with the date of the last update indicated.
Changes to these terms do not in themselves alter the conditions of an already confirmed booking without the proper agreement of both parties.

20. Governing Law

These terms are governed by the laws of England and Wales.
If a dispute arises, the parties may attempt to resolve it through communication.
This section does not deprive either party of the right to apply to court or utilise other legal remedies provided by law.
Nothing in these terms restricts mandatory consumer rights.

21. Contact Information

If you have any questions regarding the website, photographs, booking, or these terms, please contact me via Instagram, Telegram, WhatsApp, or the email address specified on the website.
